How defence contracts are awarded in Europe
Inside the EU, defence and sensitive security contracts above the thresholds follow Directive 2009/81/EC, which allows the negotiated procedure with prior publication and gives buyers more room on security of supply than the general procurement rules. The UK replaced its Defence and Security Public Contract Regulations with the Procurement Act 2023, in force since 24 February 2025.
Not every contract is advertised. Purchases that touch essential security interests can be exempted under Article 346 of the Treaty on the Functioning of the European Union, and government to government deals are common for large weapons systems.
